B) Col­lec­tion, Pro­cessing and Use of Per­son­al Data

1.) Per­son­al data is such inform­a­tion which can be used to find out per­son­al or fac­tu­al cir­cum­stances (such as name, address, tele­phone num­ber, e‑mail address). We col­lect, pro­cess and use per­son­al data only inso­far as this is per­miss­ible or ordered accord­ing to the DSGVO, the Ger­man Data Pro­tec­tion Law (Ger­man: Bundes­datens­chutzge­setz (BDSG) or oth­er European or Ger­man leg­al pro­vi­sions or when the con­cerned party has giv­en con­sent hereto. The gen­er­al use of our web­site is pos­sible without provid­ing your per­son­al data – as far per­son­al data will be col­lec­ted, this is on a vol­un­tary basis only.

2.) Your vis­it to our web­site is auto­mat­ic­ally logged. The IP address cur­rently used by your PC, date and time, the browser type and oper­at­ing sys­tem of your PC and the pages you are view­ing are recor­ded. A ref­er­ence to indi­vidu­als is not pos­sible. No oth­er eval­u­ation of the data, with the excep­tion for stat­ist­ic­al pur­poses in anonym­ous form, will occur.

The sys­tem must tem­por­ar­ily store the IP address in order to trans­mit the web­site to the vis­it­or’s com­puter. For this pur­pose, it is also neces­sary to keep the IP address stored for the dur­a­tion of the ses­sion. The res­ult­ing stor­age of data in log files is done to ensure the func­tion­al­ity of our web­site and to adapt it to the require­ments of our vis­it­ors. We have lis­ted under B) 5. how we use and pro­cess the data in detail (see below).

3.) Provided that a vis­it­or of our web­site registers for per­son­al­ized ser­vices (e.g. order­ing a news­let­ter, requests for inform­a­tion etc.), we ask for cer­tain con­tact details or oth­er per­son­al data. The user is free to decide wheth­er or not to provide this data.

4.) Leg­al basis for the pro­cessing of per­son­al data, provided that pri­or con­sent of the con­cerned per­son has been obtained, res­ults from Art. 6 para. 1 lit. b DSGVO; inso­far as the pro­cessing is based on the ful­fil­ment of a leg­al oblig­a­tion, this is done in accord­ance with Art. 6 para. 1 lit. c DSGVO.

In spe­cial cases in which the vital interests of the con­cerned party (or anoth­er nat­ur­al per­son) require the pro­cessing of per­son­al data, the leg­al basis for this res­ults from Art. 6 para. 1 lit. d DSGVO. If pro­cessing is neces­sary for the pro­tec­tion of the leg­al interests of our com­pany or third parties and the interests of the con­cerned party pre­dom­in­ate, tak­ing into account his fun­da­ment­al rights and fun­da­ment­al freedoms, the leg­al basis for this is Art. 6 para. 1 lit. f DSGVO.

5.) In the con­text of using this web­site, your per­son­al data will be pro­cessed by us primar­ily for the fol­low­ing purposes:

to provide inform­a­tion, respond to con­tact requests etc. via the con­tact form and/​or a news­let­ter
for the stat­ist­ic­al eval­u­ation of cumu­lated and anonym­ized data

C) Dele­tion of Data and Stor­age Period

The per­son­al data col­lec­ted by us will be deleted as soon as the pur­pose of stor­age ceases to apply (devi­at­ing from this only if con­tinu­ous stor­age is stip­u­lated in a stat­utory pro­vi­sion, pos­sibly for data pro­cessing). Dele­tion or block­ing of data shall take place at the latest when the leg­ally pre­scribed stor­age peri­od expires, provided that there is no neces­sity for fur­ther stor­age of the data in order to con­clude a con­tract or to ful­fil a con­trac­tu­al relationship.

D) Rights of the Con­cerned Persons

As the con­cerned per­son through the data pro­cessing, you are par­tic­u­larly entitled to the rights stated below, which arise in each case from the DSGVO.

D1) Right to Con­firm­a­tion and Right to be Informed

You are entitled (pur­su­ant to Art. 15 DSGVO) to request con­firm­a­tion of wheth­er we pro­cess data about you and to receive inform­a­tion about this data and a copy of the data we have stored about you.

D2) Right to Rec­ti­fic­a­tion and Right to Erasure

In accord­ance with Art. 16 DSGVO, you have the right to demand the rec­ti­fic­a­tion of incor­rect data or the com­ple­tion of your per­son­al data stored at our com­pany without delay. Fur­ther­more, accord­ing to Art. 17 DSGVO, you are entitled to request the eras­ure of your per­son­al data stored by us. This applies, unless there are oth­er leg­al grounds on our part that pre­vent such action (this may for example be the right to free­dom of expres­sion, the right to inform third parties when ful­filling leg­al oblig­a­tions; reas­ons of the pub­lic interest or the asser­tion, exer­cise or defence of leg­al claims on our behalf or on the part of third parties).

D3) Right to Restrict Pro­cessing and Right to Object

Accord­ing to Art. 18 DSGVO, you are entitled to demand the restric­tion of pro­cessing of your DSGVO, you are entitled to object if there are reas­ons arising from your par­tic­u­lar situ­ation or if the objec­tion is dir­ec­ted against dir­ect advertising.

Under Art. 21 DSGVO, you are entitled to object if there are reas­ons arising from your par­tic­u­lar situ­ation or if the objec­tion is dir­ec­ted against dir­ect advertising.

D4) Rights related to auto­mated indi­vidu­al decision-mak­ing, includ­ing profiling

Accord­ing to Art. 22 DSGVO, you are entitled to be informed on the pres­ence of auto­mated decision mak­ing includ­ing pro­fil­ing and on mean­ing­ful inform­a­tion about the logic involved, as well as the scope and the inten­ded implications.

D5) Right to Data Port­ab­il­ity and Right of Appeal

Fur­ther­more, in accord­ance with Art. 20 DSGVO you are entitled to receive data con­cern­ing you or to demand the trans­fer of this data to oth­er respons­ible parties.

Moreover, in accord­ance with Art. 77 DSGVO, you are gen­er­ally entitled to file a com­plaint with the respons­ible super­vis­ory author­ity if you are of the opin­ion that the pro­cessing of per­son­al data con­cern­ing you infringes the DSGVO or if we do not com­ply with oth­er data pro­tec­tion reg­u­la­tions in accord­ance with our leg­al obligations.

E) Hyper­links to oth­er websites

Our web­site con­tains hyper­links to web­sites of third parties. As soon as you activ­ate them, you are with­in the sphere of influ­ence of this (oth­er) web­site and sub­ject to their data col­lec­tion and data pro­tec­tion regulations.

F) Use of Cookies

Gen­er­ally, web­sites that use cook­ies con­tain a ban­ner indic­at­ing the use of cook­ies. This allows you to decide wheth­er you want to accept cook­ies or not. Third-party con­tent such as videos from Vimeo, Face­book, maps from Google Maps or graph­ics from oth­er web­sites are integ­rated into this website.

This requires that the pro­viders of the con­tent (here­in­after referred to as “third party pro­viders”) per­ceive the IP address of vis­it­ors, since without such IP address the con­tent can­not be sent to the browser of the respect­ive user. The IP address is there­fore neces­sary to visu­al­ize the content.

We have no influ­ence on the stor­age of your IP address and oth­er inform­a­tion (e.g. for stat­ist­ic­al pur­poses) by third-party pro­viders. Please refer to the rel­ev­ant data pro­tec­tion reg­u­la­tions of the respect­ive third-party pro­viders as spe­cified, for more information.

We have integ­rated the fol­low­ing Google ser­vices to our website:

G1a) Google Analytics

On our Inter­net pages we use the web ana­lys­is ser­vice Google Ana­lyt­ics (pro­vider: Google Inc, 1600 Amphi­theatre Park­way Moun­tain View, CA 94043, USA). Google Ana­lyt­ics uses cook­ies, which are text files placed on your com­puter, to help the web­site ana­lyse how vis­it­ors use the site. Our web­site includes the data ser­vice Google Maps (pro­vider: Google Inc, 1600 Amphi­theatre Park­way Moun­tain View, CA 94043, USA) for the present­a­tion of an inter­act­ive map and, if neces­sary, for the cre­ation of a route descrip­tion. This is a Google map ser­vice, through the use of which inform­a­tion about the usage of our web­site, includ­ing your IP address and, if you use the route plan­ner func­tion, the start­ing address, are trans­mit­ted to the Google Map ser­vice in the USA. The data you have provided (in par­tic­u­lar your name and e‑mail address) will be stored by us for the pur­pose of pro­cessing your enquiry. We will not use this data (or pass it on to third parties) in any oth­er way. This data will be deleted at a reas­on­able peri­od of time after the end of the con­ver­sa­tion, whereby we assume the end when the rel­ev­ant request has been finally clarified.
